ACQUITTAL – Rape/Sexual Battery/Gross Sexual Imposition
A contested custody matter resulted in allegations by the mother of a 10 year-old child that her biological father had done terrible things to their daughter. The client was charged with Sixteen counts of First Degree Felony Rape, One count of Second Degree Felony Sexual Battery and Sixteen counts of Gross Sexual Imposition. Discovery responses from the State of Ohio included extensive medical examination records and DNA test results.
Upon commencement of a Jury Trial, each witness called by the prosecution was thoroughly cross-examined, including several doctors, nurses, and DNA experts. At the conclusion of the Jury Trial the client was Acquitted of all Thirty-Three counts pursuant to Criminal Rule 29.
