A night of fun and drinks with friends came to an end and on her way home, client was stopped by State Troopers for a small traffic violation which turned into First Degree Misdemeanor charges of OVI (impaired) and a breath test above .08 resulted in an additional First Degree Misdemeanor charge of OVI (prohibited concentration).  Her license was suspended and she was issued a citation for the offenses.

After obtaining driving privileges for the client, we obtained Discovery responses from the prosecuting attorney which included video of the stop and the Trooper's interaction with the client.  These responses demonstrated several issues for the prosecutor's consideration and negotiations resulted in a reduction of the OVI charges to a lesser charge of Physical Control and the client's driver's license was reinstated and the remaining traffic charges were dismissed.
