DUI/OVI

​In Ohio a DUI (now known as an OVI) is a serious traffic offense with serious potential penalties. From the initial stop by the police officer to your first court appearance, everything that you say and do is being scrutinized.

Ohio DUI law has changed significantly in the past several years. A conviction for a DUI offense carries certain maximum and minimum penalties. Aside from going to jail, other penalties may include: obtaining special license plates, ignition interlock devices, vehicle immobilization and/or forfeiture and a suspension of your driver’s license. But OVI cases can be and are frequently won.

There are many factors to consider, when preparing your Ohio DUI defense. In many instances a video of the initial traffic stop may be obtained. In addition, it is important to obtain and review records relating to the police officer’s notes of the traffic stop, the results of any field sobriety tests and records relating to any machine or test that was used to determine your blood alcohol level. 1st Offense within 6 years (Refusal or test below .17)

  •      Degree of Offense = First Degree Misdemeanor
  •      Jail = Minimum 3 days jail or DIP; Maximum 180 days jail
  •      Fines = Minimum $375.00; Maximum $1,075.00
  •      Counseling = Optional
  •      License Suspension = Class 5 (Minimum 6 months; Maximum 3 years)
  •      Driving Privileges = After 15 days
  •      Restricted Plates/Ignition Interlock = Both Optional
  •      Vehicle Immobilization/Forfeiture = No

1st Offense within 6 years (High Test or Refusal with Prior in 20 years)

  •      Degree of Offense = First Degree Misdemeanor
  •      Jail = Minimum 6 days jail or 3 days jail and 3 days DIP; Maximum 180 days jail
  •      Fines = Minimum $375.00; Maximum $1,075.00
  •      Counseling = Optional
  •      License Suspension = Class 5 (Minimum 6 months; Maximum 3 years)
  •      Driving Privileges = After 15 days
  •      Restricted Plates/Ignition Interlock = Plates required; Interlock optional
  •      Vehicle Immobilization/Forfeiture = No

2nd Offense within 6 years (Low Test)

  •      Degree of Offense = First Degree Misdemeanor
  •      Jail = Minimum 10 days jail; Maximum 180 days jail
  •      Fines = Minimum $525.00; Maximum $1,625
  •      Counseling = Mandatory assessment and recommended treatment
  •      License Suspension = Class 4 (Minimum 1 year; Maximum 5 years)
  •      Driving Privileges = After 45 days
  •      Restricted Plates/Ignition Interlock = Plates required; Interlock required
  •      Vehicle Immobilization/Forfeiture = 90 days immobilization

2nd Offense within 6 years (High Test or Refusal with Prior in 20 years)

  • Degree of Offense = First Degree Misdemeanor
  • Jail = Minimum 20 days jail; Maximum 180 days jail
  • Fines = Minimum $525.00; Maximum $1,625.00
  • Counseling = Mandatory assessment and recommended treatment
  • License Suspension = Class 4 (Minimum 1 year; Maximum 5 years)
  • Driving Privileges = After 45 days
  • Restricted Plates/Ignition Interlock = Plates required; Interlock required

3rd Offense within 6 years (Low Test)

  • Degree of Offense = Unclassified Misdemeanor
  • Jail = Minimum 30 days; Maximum 1 year
  • Fines = Minimum $850.00; Maximum $2,750.00
  • Counseling = Alcohol addiction program mandatory
  • License Suspension = Class 3 (Minimum 2 years; Maximum 10 years)
  • Driving Privileges = After 180 days
  • Restricted Plates/Ignition Interlock = Pates required; Interlock required
  • Vehicle Immobilization/Forfeiture = Forfeiture

3rd Offense within 6 years (High Test or Refusal with Prior in 20 years)

  • Degree of Offense = Unclassified Misdemeanor
  • Jail = Minimum 60 days; Maximum 1 year
  • Fines = Minimum $850.00; Maximum $2,750.00
  • Counseling = Alcohol addiction program mandatory
  • License Suspension = Class 3 (Minimum 2 years; Maximum 10 years)
  • Driving Privileges = After 180 days
  • Restricted Plates/Ignition Interlock = Pates required; Interlock required
  • Vehicle Immobilization/Forfeiture = Forfeiture
